Will of Anne Gould 1798-1855

This is the last Will and Testament of me Anne Gould of No. 8 Adelaide Crescent in the Parish of Brighton in the County of Sussex Spinster made this third day of September one thousand eight hundred and fifty three I direct my just debts funeral testamentary and incidental expences to be first paid and I wish that my funeral shall be conducted in the plainest manner that my Executors shall think advisable Also I give to my Brother the Reverend William Gould of Willesborough in the County of Kent Clerk the sum of three hundred pounds sterling for his own use absolutely Also I give to my Nephew John Coker Egerton Esquire son of my Brother in Law The Reverend John Egerton of Vale Mascal Bexley Kent Clerk the sum of fifty pounds sterling for his own use absolutely for the trouble he will have in acting as Executor to this my Will Also I give the sum of fifty pounds sterling to my Nephew Hugh Aldersey Egerton Also I give five pounds sterling for a ring or other remembrance of me to each of my five Brothers Nathaniel Gould Richard Gould The Reverend Joseph Gould Philip Gould and the said William Gould Also I give the sum of five pounds sterling for the like purpose to each of my Sisters in Law the Wives of them my said five Brothers Also I give the sum of five pounds sterling for the like purpose to each of my three Brothers in Law The Reverend Thomas Anderson The Reverend John Egerton and Nathan Wetherell Esquire Also I give the sum of one hundred pounds sterling to each of my Nieces Susan Milne and Fanny Hinde Also I give to my said Brother The Reverend Joseph Gould the sum of one hundred pounds sterling to be applied by him in whatsoever way he may think best for the benefit of the poor of the Parish of Burrwash [[sic] in Sussex Also I give the like sum of one hundred pounds sterling to my Brother The Reverend William Gould to be by him applied in whatever way he think best for the benefit of the poor of the Parish of Willesborough Also I give the sum of nineteen guineas sterling to my Niece Mary Anderson Also I give the sum of nineteen guineas sterling each to my three Nieces Frances Lydia Gould Caroline Gould and Harriet Gould daughters of my said Brother Nathaniel Gould Also I give the sum of nineteen guineas sterling each to my two Nieces Lydia Gould and Ellen Maria Gould daughters of my said Brother The Reverend Joseph Gould Also I give the sum of nineteen guineas sterling to each of my two Nieces Lucy Egerton and Elizabeth Augusta Egerton daughters of my said Sister Ellen Egerton Also I give the sum of nineteen guineas sterling each to my three Nieces Susan Margaret Wetherell Ellen Ricarda Wetherell and Elizabeth Harriet Wetherell Also I give the sum of nineteen guineas sterling to my Niece Florence Helena Gould daughter of my said Brother Philip Gould Also I give the sum of nineteen guineas sterling to my Niece Fanny Jane Gould daughter of my said Brother The Reverend William Gould Also I give the sum of nineteen guineas sterling to each of the Servants who shall be living with me at the time of my decease provided my Sister Harriet Gould approves of their conduct Also I give to my Sister Harriet Gould for her own use all or such parts of the household goods and furniture books plate linen china clothes and other articles and things that may be in and about my dwelling house and premises at the time of my decease and which may be then considered to belong to me Also I give and bequeath All the Residue and Remainder of my ready monies and securities for money monies in the public stocks or funds goods chattels rights credits and personal estate whatsoever and wheresoever and whether in possession reversion or expectancy or hereafter to become due to me (and not hereinbefore otherwise disposed of) and all my estate and interest therein to my said Brother The Reverend William Gould and my said Nephew John Coker Egerton their executors and administrators Upon trust that they or the survivor of them or his executors or administrators shall and do as soon as conveniently may be after my decease convert into money call in and receive such parts of my said residuary personal estate as shall not be invested in the Funds or other Government securities at the time of my decease and to invest and continue respectively all my said residuary personal estate at interest in the Funds or other Government securities and to pay the interest dividends and clear yearly proceeds thereof as the same shall be received unto my said Sister Harriet Gould for and during her natural life and from and immediately after the decease of my said Sister Harriet Gould to divide and pay the said residuary personal estate trust monies and premises in the manner following namely to pay the sum of two thousand pounds sterling part thereof to my Nephew Nathaniel Gould son of my said Brother Nathaniel Gould and then to pay the sum of three thousand and five hundred pounds sterling other part thereof to my said Brother Philip Gould if shall be then living but if he shall be then dead to pay the said sum of three thousand and five hundred pounds unto and equally between all and every the child and children of my said Brother Philip Gould that shall be then living and the issue of such of them as shall be then dead leaving issue per capita and per stirpes respectively and then also to pay the sum of one thousand pounds sterling other part thereof to the three oldest sons that shall be then living of my said Sister Ellen Egerton to be equally divided amongst such three oldest sons and then also to pay the sum of five hundred pounds sterling other part thereof unto my said Sister Susan Wetherell if she shall be then living but if she shall be then dead to pay the said sum of five hundred pounds unto and equally divided between all and every the child and children of my said Sister Susan Wetherell that shall be then living and the issue of such of them as shall be then dead leaving issue per capita and per stirpes respectively and then also to pay all the remainder of the said trust monies and premises unto my said Brother Philip Gould to whom I bequeath such legacies and bequests as may happen to become lapsed and I constitute him my Residuary Legatee but without prejudice to the gifts bequests and trusts hereinbefore expressed Provided always and I declare that the receipts of my said Trustees or the survivor of them his executors or administrators for all or any monies which shall come to their or his hands by virtue of this my Will shall effectually discharge the persons paying the same for so much as in such receipts shall be expressed to be received and that such persons shall not afterwards be accountable for the loss or nonapplication of the same monies or any part thereof Provided also and my Will further is that my said Trustees shall not be charged with any other trust monies interest dividends and premises than they shall respectively receive nor with any loss or damage that may happen without their wilful default nor the one for the other of them but each of them only for himself and his own acts deeds receipts and disbursements And I do hereby appoint my said Brother The Reverend William Gould and my said Nephew John Coker Egerton Executors and Trustees of this my Will and do revoke all former Wills and Codicils by me made In Witness whereof I have to this my last Will and Testament contained in this and the three preceding sheets of paper signed my name the day and year first above written – Anne Gould – The writing contained in this and the three preceding sheets of paper was signed by the above named Anne Gould the Testatrix in the presence of us who were present at the same time and we do hereby attest and subscribe our This is a Codicil to my Will above written Whereas by my said Will I have bequeathed one hundred pounds to my Brother William Gould to be by him applied in whatever way he may think best for the benefit of the poor of the said Parish of Willesborough Now I do hereby revoke the said bequest of the said one hundred pounds to my said Brother William Gould and do hereby give the said sum of one hundred pounds to my Niece Fanny Hinde for her absolute use and benefit dated this 28th. day of Octr. 1854 – Anne Gould – Signed and published by the above named Anne Gould in the presence of us both being present at the same time who in her presence & in the presence of each other have hereunto signed our names as Witnesses – Charlotte Dixon – William Henley

Proved at London with a Codicil 20th. June 1855 before The Worshipful Francis Thomas Pratt Doctor of Laws and Surrogate by the oaths of The Reverend John Coker Egerton Clerk (heretofore John Coker Egerton Esquire) the Nephew one of the Executors to whom Administration was granted having been first sworn duly to administer. Power reserved of making the like Grant to The Reverend William Gould the Brother the other Executor when he shall apply for the same.
