Will of Philip Hunt 1772-1838

I The Reverend Philip Hunt of Aylsham in the County of Norfolk Clerk do hereby make and declare this to be my last Will and Testament First I give and devise unto my Nephew John Rose Hall of Manchester in the County of Lancaster Merchant and his heirs all my Estate called Cockshoot Lydiat in the Parish of Brimfield in the County of Hereford And Richards Castle in the County of Salop Subject nevertheless to and charged with the payment of the legacy or sum of eight hundred pounds which I hereby give and bequeath unto his Sister my Niece Fanny Cicely Moody Gethen Widow to be paid at the end of six calendar months after my decease I appoint my Nephews the Revd Joseph Gould of Burwash in the County of Sussex Clerk and the said John Rose Hall and my friend and Solicitor William Repton of Aylsham aforesaid Gentleman to be Executors and Trustees of this my Will And I give and devise all my Estate called Ashwood Park in the Parish of Eye in the said County of Hereford and all and every other my Manors messuages lands and heredit[[ament]s wheresoever situate and of whatever tenure the same may be unto them my said Trustees and Executors and the Survivors and Survivor of them and the heirs of such Survivor upon trust that they my said trustees and Executors and Survivors or Survivor of them or the Executors or adm[[inistrat]ors of such Survivor do and shall as soon as conveniently may be after my decease make sale and absolutely dispose of the same either by public auction or private contract and either together or in parcels for the most money that can be reasonably obtained And I hereby declare it to be my will and mind that the receipt or receipts of my said Trustees and Executors or the Survivors or Survivor of them or the ex[[ecut]ors or adm[[inistrat]ors of such survivor shall be good and valid discharge for such purchase monies and that the purchaser and purchasers of my said Real Estates shall be absolutely discharged of and from the same and not be answerable or accountable for any loss misapplication or nonapplication of the said purchase money or any part thereof and subject to the payment of all my just debts funeral and Testamentary expences I give and bequeath all my monies Effects and Personal Estate and the monies arising from the sale of my Real Estates hereby directed to be sold unto and to be equally divided among all the children of my late Sister Frances Gould Widow share and share [[alike omitted?] and it is my will and intent that neither of my said trustees or executors for the time being acting in Execution of this my Will shall be answerable or accountable for more money than he shall actually receive nor for the acts receipts and defaults of the others and other of them nor for any involuntary loss but each for his own acts receipts and defaults only and that each of them shall deduct and retain to himself out of the monies which shall come to his hand by virtue of this my Will and allow to the others or other of them all such losses costs and expences as he or they shall or may respectively sustain or be put unto in or about the Execution or defence of this my Will and I hereby revoke and make void all former and other Wills and Testaments by me at any time heretofore made and do declare this to be my only last Will and Testament In Witness whereof I the said Philip Hunt the Testator have to this my last Will and Testament set my hand the seventh day of September in the year of our Lord one thousand eight hundred and thirty eight – Philip Hunt – Signed by the Testator Philip Hunt in the presence of us present at the same time who have hereunto subscribed our names as witnesses – Fredc. I the Reverend Philip Hunt of Aylsham in the County of Norfolk Clerk Doctor of Laws declare this to be a Codicil to be added to and taken as part of my last Will and Testament dated the seventh day of September instant I give and devise to my Nephew John Rose Hall and his heirs my land in the Parish of Hertford [[Hartford] in the County of Huntingdon And I give unto the Reverend John Anderson a pair of large silver candlesticks with plated branches belonging to the same I give and bequeath unto the Dean and Chapter of Canterbury a bound copy of the Work called the Woburn Marbles to be deposited in the Cathedral library I give and bequeath unto my Nephew the Reverend Joseph Gould another Copy of the said Work and all my other printed books also all my Manuscripts and letters and the entire and uncontrolled power of disposing of the same he being already acquainted with my intentions as to the disposal of them I give and bequeath unto Nathaniel Gould 1787-1867 Esquire my Nephew my chased Coffee pot and tea pot my large double gilt silver Cup containing the complimentary inscription together with the Cover and two flat gilt table spoons commonly called Convent spoons I give and bequeath unto the Minister and Churchwardens of the Parish of Aylsham the two smaller silver gilt Cups to be used for the celebration of the Lords Supper and hereafter to form part of the Communion Plate of that Parish I give unto each of my eight Godchildren after mentioned the sum of nineteen pounds and nineteen shillings (that is to say) Philip Gethen of Hereford Philip Gould of Manchester Philadelphia Smith daughter of Captain Smith Royal Navy of Bedford James Richard Anderson of Felsham Suffolk Philip Reginald Egerton of Bunbury Cheshire Harriet Gould daughter of Nathaniel Gould 1787-1867 Esquire and two of the children of the Reverend G.H. Bowers Rector of Covent Garden London And in case either or both of the said last mentioned children shall now be dead or shall die without receiving such legacy I desire the same may be paid to their father for his own use I give to each of my Servants who may be living with me as Indoor Servants at the time of my decease half a years wages beyond what may be then due to them I direct that all the above legacies shall be paid out of my Personal Estate as soon as conveniently may be after my decease And I confirm my said Will in all respects not hereby altered and declare that William Repton therein named as one of my Executors shall be entitled to make the Customary charges as an Attorney and Solicitor for all business transacted by him in the Execution of this my Will In Witness whereof I have hereunto set my hand this thirteenth day of September in the year of our Lord one thousand eight hundred and thirty eight – Philip Hunt – Signed by the Testator Philip Hunt in the presence of us present at the same time who have hereunto subscribed our names as Witnesses Fred. Appeared Personally Frederic Roe of Aylsham in the County of Norfolk Gentleman and made oath that he is one of the subscribed witnesses to the last Will and Testament and the Codicil thereto of the Revd Philip Hunt late of Aylsham in the County of Norfolk Doctor of Laws deceased the said Will bearing date the seventh and the said Codicil bearing date the thirteenth days of September one thousand eight hundred and thirty eight now hereunto annexed and he further made oath that on the seventh day of September aforesaid the said Testator duly executed his said Will by signing his name at the foot or end thereof in the presence of this deponent and of Isaac John Moore the other Subscriber Witness thereto (both of whom were present at the same time and this deponent and the said Isaac John Moore thereupon attested and subscribed the said Will in the presence of the said Testator And he further made oath that on the thirteenth day of September aforesaid the said Testator duly executed the said Codicil to his said Will by signing his name at the foot or end thereof in the presence of this deponent and of Frederic Parson Smith the other subscribed witness thereto) both of whom were present at the same time and this deponent and the said Frederic Parson Smith thereupon attested and subscribed the said Codicil in the presence of the said Testator.
Fredc. Roe – On the fourteenth day of November 1838 the said Frederic Roe was duly sworn to the truth of this affidavit by virtue of the annexed Commission Before me P. Pering Minister of the Parish of Aylsham in the County of Norfolk Commissioner.

Proved at London with a Codicil 17th Nov. 1838 before the Judge by the oaths of the Revd Joseph Gould Clerk and John Rose Hall the Nephews and William Repton the Ex[[ecut]ors to whom adm[[inistrati]on was granted having been first sworn by Com[[missi]on duly to adm[[iniste]r.
