Will of Sarah Gethen 1795

In the Name of God Amen. I Sarah Gethen (Wife of Saml. Moody Gethen) late of Lawrence Lane in the city of London Warehouseman but now of the city of Hereford Linen Draper do make and publish this my last Will and Testament in manner following that is to say Whereas by indenture of Settlement bearing date the eighth day of January One thousand seven hundred and ninety made previous to my marriage with my dear husband it was agreed that the Sum of Seven hundred and sixty six Pounds fifteen shillings and sixpence three per cent Consolidated Bank Ann[[uitie]s (purchased with that Sum of Six hundred Pounds being part of my fortune) standing in the names of Henry Hemans and Charles Howgrave in the said Settlement mentioned should continue in their names and that they should stand possessed thereof In trust for me until my then intended marriage should take effect (and which soon afterwards did take effect) and afterwards in trust to sell and dispose of the said Annuities and to pay the money arising therefrom as I should notwithstanding my coverture with the consent of my said dear husband and the said Henry Hemans and Charles Howgrave direct and appoint and for want of such direction and until the same should be made in trust to pay the interest dividends and produce of the said Annuities into my hands or as I should direct for my life for my separate use notwithstanding my intended coverture and that the same should not be subject to the debts controul or engagements of my said dear husband and that my receipt alone should be a discharge for the same And from and after my decease then upon such trusts and to and for such intents and purposes and under and subject to such declarations and agreements as I should notwithstanding my coverture by and deed or writing or writings under my hand and seal to be truly executed in the presence of two or more credible witnesses or by my last Will and Testament in writing to be by me truly signed sealed published and declared in the presence of the like number of witnesses direct limit and appoint as in and by the said indenture reference thereto being had will more fully appear Now therefore in pursuance of the power given and reserved to me in and by the said indenture and of all other powers and authorities to me given and me hereunto enabling and in exercise of the same I do by this my last Will and Testament in writing only signed sealed published and declared in the presence or two credible witnesses whose names are hereunto subscribed direct limit and appoint the said Sum of Seven hundred and sixty six Pounds fifteen shillings and sixpence three percent Consolidated Bank Annuities so standing in the name of the said Henry Hemans and Charles Howgrave in manner following that is to say I direct limit and appoint that the said Bank Annuities shall as soon as conveniently may be after my decease be transferred into the names of my dear husband and the said Henry Hemans and my brother Charles John Hemans of Watling Street London and the interest dividends and produce thereof applied towards the maintenance cloathing and education of all my children during their respective minorities and the said Bank Annuities shall be divided between them equally as they attain their respective ages of twenty one years but in case either or any of them shall happen to die before they attain that age leaving issue then I direct and appoint that the share of such child or children so dying shall be paid to such issue at such time their his or her parent or parents share would have become payable And in case either or any of my said children happen to die under age and without issue then my will is that the share or shares of such children or child so dying shall go to the Survivors or Survivor of them and in case all my children but one shall happen to die under age and without issue then I direct and appoint the whole of the said bank Annuities to such only child at the time and in manner aforesaid And in case all my children shall happen to die under age and without issue then I direct limit and appoint the whole of the said Sum of Seven hundred and sixty six Pounds fifteen shillings and sixpence three per cent Consolidated Bank Annuities to my said dear husband he paying to my three brothers the said Charles John Hemans Bewley Wynne Hemans and Alfred Hemans and to the said Henry Hemans the Sum of ten pounds each and my will is that my said trustees shall not be answerable for each other or for the acts of each other but each of them for himself and his own Acts only and that they shall not be answerable for any involuntary loss of the said trust money or any part thereof and that they shall retain and reimburse themselves for all such costs charges damages and expenses as they or either of them shall sustain or be put unto for or by reason of the trusts hereby in them reposed or the management or execution thereof And I appoint my said dear husband and the said Henry Hemans and Charles John Hemans Executors of this my Will In Witness whereof I have hereunto set my hand and Seal this fifth day of May One thousand seven hundred and ninety five – Sarah Gethen LS – Signed sealed Proved at London 29th. July 1815 before the worshipful Richard Henry Cresswell Doctor of Laws and Surrogate by the Oaths of Samuel Moody Gethen 1764-1836 the husband and Henry Hemans the surviving Ex[[ecut]ors to whom adm[[inistrati]on was granted being first sworn duly to adm[inister].
